How a Topamax Attorney Can Help

If you or a loved one took Topamax or Topiramate while pregnant and gave birth to a child with an oral defect or other birth defect, you may be eligible for compensation for your medical expenses, pain, suffering, and more. It is important to consult with a Topamax Attorney who is experienced in pharmaceutical litigation to get the largest settlement or judgment possible.

Topamax is a widely prescribed anti-seizure medication approved by the FDA for the treatment of epilepsy in adults and children as well as the treatment of migraines. Topamax is an effective anticonvulsive; unfortunately Topamax has been shown to dramatically increase the risk of oral defects in newborns. Birth defects associated with Topamax use during pregnancy include cleft palate, cleft lip, and other development malformations.

The FDA gave Topamax a Pregnancy Category C when it approved for the treatment of seizures Topamax in 1996. A Pregnancy Class C rating means that animal reproduction studies demonstrated an adverse effect on lab animal fetuses and no controlled research in humans. But potential benefits warrant the use of Topamax in pregnant women despite risks.

Despite knowing that Topamax may have adverse effects on a developing fetus, the makers of Topamax did little to research the effects of Topamax on the development of human fetuses. In 2011 the FDA reported that women who take Topamax during pregnancy have more than twice the risk of having a child with oral defects. After 14 years of Topamax being widely prescribed to women for treatment of epilepsy, seizures, and migraine headaches, the FDA required the makers of Topamax to update the warning label to a Pregnancy Category D drug. As a Category D drug, Topamax now carries a warning that there is evidence of risks for fetal defects or miscarriage in humans.

The FDA recommends to doctors that women who are pregnant and women who may become pregnant be prescribed alternatives to Topamax for treatment of seizures and migraines. Women who took Topamax during the first trimester of pregnancy were three times more likely to have a child that developed cleft palate or cleft lip compared to women who took a different anti-seizure medication.

From 2007 to 2010 over 32 million Topamax prescriptions were written for over 4 million persons. Many of the women prescribed Topamax while pregnant or who became pregnant while taking Topamax had a child born with an oral defect including a cleft palate or cleft lip.

If you or someone you love took Topamax while pregnant and have a child that was born with cleft lip, cleft palate, or another birth defect, contact an experienced Topamax Attorney to learn about your rights. You may be eligible for compensation for medical bills, pain and suffering because of your child’s Topamax related birth defect.
